1. Introduction ​

These Affiliate Terms and Conditions ("Terms") apply to your participation in the Lottery Logix Affiliate Program (the "Program"). By participating in the Program, you agree to be bound by these Terms. If you do not agree to these Terms, you are not eligible to participate in the Program.

2.Eligibility​

To be eligible to participate in the Program, you must be at least 18 years old and have a valid email address. You must also have a website, YouTube channel, or other online presence where you can promote the Lottery Logix app (the "App").

3. Commission

As an affiliate, you will earn an agreed-upon commission on every scratch-off subscription that is generated through your unique affiliate link. You will receive your commission through PayPal or another payment method of your choice that is offered through our third-party affiliate tracking platform.

 

4. Promotional Materials

We will provide you with banner ads, YouTube content video ideas, and other promotional materials that you can use to promote the App. You may not modify these materials or use them in any way that is misleading or deceptive.

5. Prohibited Activities

You may not use spam or unethical marketing tactics to promote the App. You may not use the App's logo or brand in any way that is confusing or misleading. You may not promote the App in any way that is illegal or infringes on the rights of others. You may not knowingly target and promote the App to any individual under the age of 18.

6. Termination

We reserve the right to terminate your participation in the Program at any time for any reason. If your participation in the Program is terminated, you will no longer be eligible to receive commissions or use the promotional materials provided by us.

7. Disclaimer

The Program is provided "as is" and we make no warranties or representations regarding the Program or the App. We are not responsible for any errors or malfunctions that may occur in the Program or the App. We will not be liable for any damages resulting from your participation in the Program or your use of the App.

You acknowledge that your participation in the Program is at your own risk and that we are not responsible for any losses or damages that you may incur as a result of your participation.

8. Indemnification

You agree to indemnify and hold us and our affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your participation in the Program, your use of the App, or your violation of these Terms.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without giving effect to any principles of conflicts of law. Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

10. Fraudulent Activity

Fraudulent activity, including but not limited to generating false accounts or subscriptions, is strictly prohibited.  Upon the detection of any fraudulent activity, we reserve the right to terminate your participation in our affiliate program. We further reserve the right to deny payment for any commissions resulting from suspected fraudulent activity.

11. Entire Agreement

These Terms constitute the entire agreement between you and us regarding your participation in the Program. If any provision of these Terms is found to be invalid or unenforceable, that provision shall be enforced to the maximum extent possible, and the remaining provisions shall remain in full force and effect.
